Terms & Conditions

These Terms & Conditions apply to every offer from MAYTEN STUDIO and to every distance contract and order concluded between MAYTEN STUDIO and the consumer.

Article 1 - Definitions

In these Terms & Conditions, the following definitions apply: reflection period means the period during which the consumer may exercise the right of withdrawal; consumer means a natural person not acting for professional or commercial purposes; day means calendar day; continuing transaction means a distance contract relating to a series of products and/or services delivered or purchased over time; durable medium means any tool that allows information addressed personally to the consumer or entrepreneur to be stored for future consultation and unaltered reproduction; right of withdrawal means the consumer's ability to withdraw from the distance contract within the reflection period; entrepreneur means the natural or legal person offering products and/or services remotely to consumers; distance contract means an agreement concluded within an organized distance selling system using one or more distance communication techniques; distance communication technique means a method used to conclude a contract without the consumer and entrepreneur being in the same place at the same time; Terms & Conditions means these general conditions.

Article 3 - Applicability

These Terms & Conditions apply to every offer from the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer. Before the distance contract is concluded, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the conditions can be viewed and that they will be sent free of charge upon request.

If the contract is concluded electronically, the Terms & Conditions may be made available electronically in a way that allows the consumer to store them easily on a durable medium. If additional product or service conditions apply, these provisions also apply and, in case of conflicting conditions, the consumer may rely on the applicable provision most favorable to them.

If one or more provisions are void or annulled, the agreement and remaining conditions remain in force. Situations not covered by these Terms & Conditions will be assessed in the spirit of these Terms & Conditions.

Article 4 - The offer

If an offer has a limited validity or specific conditions, this will be clearly stated. The offer is non-binding and the entrepreneur may modify or adjust it. The offer contains a complete and accurate description of the products and/or services offered so the consumer can properly assess it. Obvious mistakes or errors do not bind the entrepreneur.

All images, specifications, and data in the offer are indicative and do not give grounds for compensation or termination. Product images are a truthful representation, but exact color display cannot be guaranteed due to screen differences.

Each offer makes clear the rights and obligations attached to acceptance, including the price, any shipping costs, how the contract is concluded, whether there is a right of withdrawal, payment and delivery methods, acceptance period, contract storage, correction of provided data, languages available, applicable codes of conduct, and minimum duration for continuing transactions where relevant.

Prices may exclude customs clearance costs and import VAT. These additional costs are borne by and at the risk of the customer where applicable.

Article 5 - The agreement

The agreement takes effect when the consumer accepts the offer and fulfills the stated conditions. If the consumer accepts electronically, the entrepreneur immediately confirms receipt electronically. Until receipt is confirmed, the consumer may dissolve the agreement.

If the agreement is concluded electronically, the entrepreneur takes appropriate technical and organizational measures to secure electronic data transfer and provides a secure web environment. The entrepreneur may, within legal limits, investigate whether the consumer can meet payment obligations and may refuse an order or attach special conditions where justified.

The entrepreneur will provide the consumer with relevant information in writing or in a way that can be stored on a durable medium, including complaint address, withdrawal instructions, warranty and after-sales information, and termination conditions where relevant. Each agreement is subject to sufficient availability of the products concerned.

Article 6 - Right of withdrawal

When purchasing products, the consumer may terminate the contract without giving reasons during a period of 14 days. This reflection period begins on the day after the consumer or a representative designated by the consumer receives the product.

During the reflection period, the consumer must handle the product and packaging with care and may only unpack or use the product as necessary to determine whether they wish to keep it. If exercising the right of withdrawal, the consumer must return the product with all delivered accessories, where reasonably possible in original condition and packaging, following the reasonable instructions provided.

The consumer must notify the entrepreneur within 14 days after receiving the product by written message or email. After giving notice, the consumer must return the product within 14 days and be able to prove timely return, for example with proof of shipment.

Article 7 - Costs in case of withdrawal

If the consumer exercises the right of withdrawal, the return shipping costs are borne by the consumer. If the consumer has paid an amount, the entrepreneur will refund it as soon as possible and no later than 14 days after withdrawal, provided the product has been received or conclusive proof of complete return has been presented.

Article 8 - Exclusion of the right of withdrawal

The entrepreneur may exclude the right of withdrawal only if clearly stated before conclusion of the agreement. Exclusion is possible for products made to consumer specifications, clearly personal items, products that cannot be returned due to their nature, products that spoil or age quickly, products whose price is subject to market fluctuations outside the entrepreneur's control, individual newspapers and magazines, unsealed audio/video/software, and hygiene products where the seal has been broken.

For services, exclusion may apply to accommodation, transport, catering, or leisure activities on a specific date or period, services begun with the consumer's express consent before the withdrawal period ends, and betting or lotteries.

Article 9 - The price

During the validity period stated in the offer, prices will not be increased except due to VAT rate changes. Products or services with prices linked to financial market fluctuations may have variable prices if this is stated in the offer. Price increases within three months after contract conclusion are only permitted if required by law. Price increases after three months are only permitted if stipulated and legally required or if the consumer may terminate the contract when the increase takes effect.

Delivery may take place in the country where transport begins. Where applicable, postal or courier services may collect import VAT or customs clearance costs from the customer. All prices are subject to printing and typographical errors, and the entrepreneur is not required to deliver at an incorrect price.

Article 10 - Conformity and warranty

The entrepreneur guarantees that products and/or services comply with the contract, the offer specifications, reasonable requirements of reliability and usability, and legal provisions existing at the time of contract conclusion. Any warranty provided does not affect the consumer's statutory rights.

Defective or incorrectly delivered products must be reported in writing within 14 days after delivery. Products should be returned in original packaging and new condition. The warranty does not apply if the consumer repaired or modified products, exposed them to abnormal conditions, treated them negligently or contrary to instructions, or if the defect results from government regulations regarding materials.

Article 11 - Delivery and implementation

The entrepreneur will take the greatest possible care in receiving and fulfilling orders. Accepted orders will be executed diligently and no later than 30 days unless a longer delivery period has been agreed. If delivery is delayed or an order cannot be fulfilled fully or partially, the consumer will be informed no later than 30 days after the order was placed. In that case, the consumer may terminate the contract without cost and may claim damages where applicable.

If termination occurs, the entrepreneur refunds the amount paid as soon as possible and no later than 14 days after termination. If delivery of an ordered product is impossible, the entrepreneur may try to provide a replacement item and will clearly indicate this at delivery. Risk of damage or loss remains with the entrepreneur until delivery to the consumer or their designated representative unless expressly agreed otherwise.

Article 12 - Continuing transactions

The consumer may terminate an indefinite contract for regular supply of products or services at any time, observing agreed termination rules and a notice period not exceeding one month. A fixed-term contract for regular supply may be terminated at the end of the fixed term with a notice period not exceeding one month.

A fixed-term contract for regular supply may not be tacitly renewed for a fixed period except where legally allowed. If a contract lasts more than one year, the consumer may terminate it after one year at any time with notice of no more than one month, unless reasonableness and fairness oppose termination before the agreed term ends.

Article 13 - Payment

Unless otherwise agreed, amounts owed by the consumer must be paid within 7 working days after the start of the reflection period. The consumer must immediately report inaccuracies in payment details. In case of non-payment, the entrepreneur may, subject to legal restrictions, charge reasonable costs communicated in advance.

Article 14 - Complaints procedure

Complaints about execution of the agreement must be submitted within 7 days after the consumer discovered the defects, with a complete and clear description. Complaints will be answered within 14 days after receipt. If more time is needed, the entrepreneur will confirm receipt and indicate when a more detailed response can be expected.

A complaint does not suspend the obligations of the entrepreneur unless the entrepreneur states otherwise in writing. If a complaint is found valid, the entrepreneur will replace or repair the delivered products free of charge at its discretion.

Article 15 - Disputes

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of HK.
